These Terms of Service (the "Terms") are an agreement between you and PersonaCraft - Male & Female Character Builder ("PersonaCraft", "we", "us", or "our"), the AI character studio that lets you design, generate, animate, and collect AI-created characters. By accessing or using PersonaCraft you agree to these Terms. If you do not agree, do not use the service.

Please also read our Privacy Policy and AI Content Disclaimer, which are part of these Terms.

1. Eligibility and age requirements

PersonaCraft is an 18+ service. You must be at least 18 years old (or the age of majority where you live, if higher) to create an account or use any feature.
On entry we ask for your date of birth to confirm you are 18 or older. Your date of birth stays on your own device - see the Privacy Policy.
Nudity, partial nudity, and explicit content are never permitted on PersonaCraft.
Providing a false date of birth, or letting a minor use your account or device to access PersonaCraft, is a material breach of these Terms.

2. Your account

Some features require an account, which you can create with an email address and password (with email verification) or by signing in with Google. Accounts are personal to you.

You are responsible for keeping your credentials secure and for all activity under your account.
You must provide accurate information and keep your email address current.
You may not share, sell, or transfer your account, or use another person's account.
Tell us promptly at thefamilyhouseshop@gmail.com if you suspect unauthorized use.

3. Credits, packs, and payments

PersonaCraft runs on a prepaid credit system. Generating images, videos, Shorts, Motion Control clips, Talking Avatar videos, and other AI features consumes credits from your balance.

Starter credits. New accounts receive a free starter credit balance. Starter credits are promotional, have no cash value, are not redeemable or transferable, and may be changed or withdrawn at any time. Some features remain locked until you purchase a credit pack.
Purchased credits. Credit packs are sold at the prices shown on the Credits page at the time of purchase. Credits are added to your balance once payment is approved. Prices, pack sizes, and the credit cost of each generation type may change at any time; changes are not retroactive to credits you already hold.
Checkout. Purchases are processed through Wix's hosted checkout. We do not receive or store your full card details. Your purchase is also subject to the payment provider's own terms.
No cash value. Credits are a limited, revocable licence to use the service. They are not money, not a stored-value or gift-card instrument, do not earn interest, and cannot be exchanged for cash, transferred between accounts, or resold.
Taxes. Prices may exclude taxes that apply where you live; any such taxes are added or collected at checkout as required.

4. Failed generations and refunds

Automatic credit returns. When a Motion Control or Talking Avatar job is charged but fails, times out, or returns no video, the system returns those credits to your balance automatically. You will see the return in your Recent activity ledger on the Credits page.
Make-good returns. If a generation is charged but clearly fails and is not automatically returned, contact support with the details and we will review it and, where appropriate, return the credits manually.
Results you simply dislike are not refundable. AI output is variable by nature. A generation that completes but does not match your taste, prompt intent, or expectations has been delivered and consumes credits.
Purchases. Credit purchases are final and non-refundable except where a refund is required by applicable law, or where we choose to grant one at our discretion. If you have a statutory right of withdrawal or cancellation, that right is unaffected by these Terms; note that by starting to spend credits you may be asking us to begin performance immediately, which can limit that right where the law allows.
Credits associated with an account terminated for breach of these Terms are forfeited.

5. Acceptable use

PersonaCraft is built to stay classy, tasteful, and fully clothed. You agree not to:

Generate or attempt to generate nudity, partial nudity, sexually explicit, or pornographic content;
Generate any content that sexualizes, endangers, or depicts minors, or any character who is or appears to be under 18 - this is an absolute prohibition and will result in immediate termination;
Create, upload, or generate content depicting, impersonating, or based on the likeness of a real, identifiable person (including celebrities and public figures) without that person's consent;
Upload photos, clothing images, audio, or other material you do not have the right to use, or that infringes anyone's intellectual property, privacy, or publicity rights;
Create content that is unlawful, hateful, harassing, defamatory, violent, or that promotes self-harm;
Use output to deceive, defraud, catfish, blackmail, or create non-consensual intimate imagery;
Present AI-generated output as a genuine photograph or recording of a real person or event where doing so would mislead others;
Circumvent, disable, or attempt to defeat the age gate, content filters, credit accounting, or any other safety or access control;
Reverse engineer, decompile, scrape, bulk-download, or use automated means to access the service or its data;
Use PersonaCraft to build, train, or benchmark a competing AI product, or resell or redistribute the service or its generation capacity;
Interfere with, overload, or disrupt the service or the infrastructure behind it.

We may filter, refuse, modify, or remove any request or content that violates this section, and we may do so automatically and without notice. Filters are imperfect and their operation is not a warranty.

6. Your content and the rights you grant us

"Your Content" means the prompts, settings, character configurations, and any photos, clothing images, or audio you upload. You keep whatever rights you already have in Your Content.

You represent that you own or are licensed to use Your Content, that you have the consent of any identifiable person appearing in it, and that its use in PersonaCraft does not break the law or infringe anyone's rights.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, adapt, and process Your Content, and to share it with the third-party providers listed in Section 9, strictly for the purpose of operating the service, generating the output you asked for, keeping your characters consistent across generations, providing support, and enforcing these Terms. We do not sell Your Content and we do not use it for advertising.

7. Generated output and ownership

We do not claim ownership of the images, videos, and text PersonaCraft generates from your prompts. Subject to your compliance with these Terms, you may use your output for your own personal, non-commercial enjoyment.
Commercial use is not granted by these Terms. Any commercial or public use of output is at your own risk and remains subject to the terms of the underlying model providers (Section 9), the law where you are, and the rights of any third parties. We make no representation that you have, or can obtain, the rights needed for a commercial use.
Output may not be copyrightable. In many jurisdictions, purely AI-generated material may receive limited or no copyright protection. We make no promise about the legal status of your output.
Output is not exclusive. AI models can produce similar or substantially identical results for different users from similar inputs. We do not promise your output is unique, original, or that no one else will receive something like it.
PersonaCraft's own software, models integrations, branding, catalog copy, UI, and design remain our property or that of our licensors. Nothing here transfers those rights to you. Some starter-credit output may carry a PersonaCraft credit or mark; do not remove it.

8. AI output - accuracy, likeness, and your responsibility

PersonaCraft is a creative tool built on third-party generative AI models. Everything it produces is synthetic and fictional. You accept the following, which are fundamental to how these Terms are priced and offered:

No accuracy warranty. Output can be wrong, distorted, anatomically implausible, off-prompt, inconsistent between runs, or simply strange. Any text, chat, or descriptive content may be inaccurate or fabricated and must not be relied on as fact, advice, or instruction.
No likeness or consistency guarantee. Features such as Character Lock, consistency, memory, and reference-image workflows are best-effort. We do not warrant that a generated character will match an uploaded reference, a previous generation, a described appearance, or any real person's likeness - and we do not warrant that it will avoid resembling a real person by coincidence.
No results guarantee. We do not promise any particular quality, resolution, duration, style fidelity, turnaround time, or number of usable results per credit spent.
Model provider limitations. Generation depends on upstream providers whose models, safety filters, pricing, availability, capacity, rate limits, and terms are outside our control and can change or fail without notice. Upstream refusals, queue delays, degraded quality, and removed models are not defects in PersonaCraft, though the credit-return rules in Section 4 still apply to charged jobs that deliver nothing.
You are responsible for how you use output. You decide what to generate, keep, publish, share, print, or monetize, and you bear the legal and reputational consequences of those decisions. Where you share output publicly, you are responsible for disclosing that it is AI-generated when the law or the platform requires it.
Entertainment only. PersonaCraft is not a source of professional, medical, legal, financial, or psychological advice, and AI companions are not a substitute for real relationships or professional care.

9. Third-party services

We rely on the following providers to run PersonaCraft. Your use of the service involves them:

Wix - application hosting, user accounts and authentication, the database that holds your characters, credit ledger, and settings, file storage for your uploads and generated media, transactional email, some AI generation, and credit purchases through Wix's hosted eCommerce checkout, which handles payment collection, order approval, and the resulting receipt. Wix Media infrastructure is also used to store and serve images. Purchases are therefore also governed by Wix's terms and privacy notice.
Kie.ai - the AI gateway used for most generation, including Grok Imagine (image and video models from xAI) and Kling models from Kuaishou for Motion Control and Talking Avatar. Prompts, settings, and the URLs of your uploaded or generated media are sent to Kie.ai so it can produce the result. Their models and safety systems apply in addition to ours.
Google - optional sign-in provider if you choose "Continue with Google".

These providers are independent third parties. We are not responsible for their acts, omissions, outages, pricing, or policy changes, and their services are not warranted by us.

10. Service availability and changes

We may add, change, suspend, or remove features, models, catalog options, credit costs, and limits at any time, including for maintenance, safety, cost, or provider reasons. We aim to keep PersonaCraft available but do not promise uninterrupted or error-free operation. Generated media and characters are stored as a convenience, not as a backup service - keep your own copies of anything you want to preserve.

11. Disclaimers

To the fullest extent permitted by law, PersonaCraft is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory - including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or trade usage. We do not warrant that the service will meet your requirements, that output will be accurate, lawful for your intended use, unique, or non-infringing, or that defects will be corrected. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded, and if you are a consumer you keep your mandatory statutory rights.

12. Limitation of liability

To the fullest extent permitted by law, PersonaCraft and its owners, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, reputational harm, or the cost of substitute services, arising out of or relating to the service or any generated output - even if we were advised such damages were possible.

To the fullest extent permitted by law, our total aggregate liability for all claims relating to the service in any twelve-month period is limited to the greater of (a) the amount you actually paid us for credits in the twelve months before the event giving rise to the claim, or (b) USD 50.

These limits apply to every theory of liability - contract, tort, negligence, strict liability, statute, or otherwise. Some jurisdictions do not allow certain exclusions or limits, so parts of this section may not apply to you; in that case our liability is limited to the maximum extent permitted.

13. Indemnity

You agree to indemnify and hold harmless PersonaCraft and its owners, operators, and suppliers from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your use of the service, the content you upload or generate, your use or distribution of output, or your breach of these Terms or of any law or third-party right.

14. Suspension and termination

You may stop using PersonaCraft at any time and may request account deletion through support.
We may suspend or terminate your access, remove content, or disable features - with or without notice - if we reasonably believe you have breached these Terms, if required for legal, safety, security, or provider reasons, or if your account is used for prohibited content.
On termination for breach, remaining credits (including purchased credits) are forfeited without refund, to the extent the law allows.
Sections that by their nature should survive - including Sections 6 to 8 and 11 to 14 - survive termination.

15. Changes to these Terms

We may update these Terms from time to time. The "last updated" date above reflects the latest revision. Where changes are material we will make reasonable efforts to highlight them in the app. Continuing to use PersonaCraft after an update means you accept the revised Terms; if you do not accept them, stop using the service.

16. General

If any provision of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a transfer of the service. These Terms, together with the Privacy Policy and AI Content Disclaimer, are the entire agreement between you and us about PersonaCraft.
